TERMS OF SERVICE

1 - Purpose
These general terms and condition aim to define the contractual relations between
- MANIDOU DESIGN SARL – Switzerland, company registered in the commercial register under number CH-626.4.014.711-5 and publisher of the site www.manidou.com.
- and any natural or legal person wishing to make a purchase via the MANIDOU website, hereinafter referred to as the Customer.
The acquisition of a property through this site implies unreserved acceptance by the Customer of these general conditions of sale.
MANIDOU DESIGN SARL reserves the right to modify its general conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the Customer.
2 - Characteristics of the goods offered
The products sold are those which appear in the catalog published on the Manidou website. These products are available for sale while stocks last. The characteristics of the products as well as the photos visible on the site are given for information purposes only. The photographs in the catalog are as faithful as possible but cannot ensure perfect similarity with the product offered, particularly with regard to the colors and cannot have contractual value. If a product is unavailable, we will inform you as soon as possible.
3 - Prices
The prices appearing in the catalog are inclusive of VAT in Swiss francs taking into account the VAT applicable on the day of the order; any change in the rate may be reflected in the price of the products. Manidou reserves the right to modify its prices at any time and without notice, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the Customer. Manidou reserves the right not to deliver products whose prices displayed are incorrect but nevertheless undertakes to inform its customers of a price difference and will allow itself to offer alternative products. Manidou may hold sales or promotions on its catalog. These offers are only valid during the period of publication on the site and cannot be requested retroactively.
4 - Orders and closing of the sale
The Customer, who wishes to purchase a product on the Manidou site, must go through the different stages of the purchasing process (summary of the products chosen and placed in the basket, identification, choice of address and delivery method and choice of the method of payment and payment under the conditions provided). Confirmation of the order entails acceptance of these conditions of sale, acknowledgment of having perfect knowledge of them and waiver of the right to rely on one's own conditions of purchase or other conditions. All the data provided and the recorded confirmation will constitute proof of the transaction. Confirmation will be worth signing and acceptance of transactions. Manidou will communicate the details of the recorded order by email.
The price of purchases made on the site www.manidou.com is due at the time of the order, without discount; Payment is made by bank credit card (Visa or Mastercard) or TWINT.
Manidou does not have access to confidential information relating to the means of payment. The information entered is encrypted and transmitted to the company STRIPE in a secure manner without Manidou or third parties being able to access it.
5 - Deliveries
Deliveries are made to the delivery address indicated by the customer during the ordering process.
Manidou delivers to all countries served by Swiss Post. Contact us for special delivery requests.
The amount of shipping costs is indicated in the “basket” section and is subject to the Customer’s approval before validation of each order; the amount may vary depending on the weight of your package and the country of delivery.

5.1. Shipping cost

Shipping costs are free in Switzerland.
Charges apply for express delivery, they can be estimated on the “Shopping Cart” page.
Deliveries outside Switzerland are made on a DDU (Delivery Duty Unpaid) basis. Swiss VAT will be deducted from the purchase price but the recipient must pay the carrier the payment of import taxes (VAT of the recipient country), as well as all costs and customs duties relating to their order and which will be requested upon delivery.

5.2. Delivery times
Delivery times apply once the payment has been registered with our accounts, the package prepared and deposited with our delivery service provider, for products in stock.
Delivery times are those of the Swiss Post, namely:
– 3 to 6 working days for Switzerland
– 7 to 14 working days for other countries, depending on the conditions of the local post office
Manidou undertakes to inform the customer of any delay in delivery but cannot be held liable for any compensation in this regard.

5.3. Terms of delivery
In the event of damage during transport, a reasoned protest must be made within three days of delivery. The Customer must contact Manidou Customer Service by email for any complaints.
The complaint must be supplemented by photos of the damage as well as the damaged part(s).
6 - Intellectual property rights
All data of whatever nature, and in particular the texts, graphics, logos, icons, images, audio or video clips, brands, software, appearing on the Site, are necessarily protected by copyright, the law trademarks and all other intellectual property rights.
Manidou, in its capacity as publisher of the Site, grants the User a right of private, non-collective and non-exclusive use of said content.
The User undertakes under these conditions not to reproduce, summarize, modify, alter or redistribute, without express prior authorization from the publisher, any text, title, application, software, logo, brand, information or illustration, for a use other than strictly private, which excludes any representation for professional purposes or mass rebroadcast.
Likewise, the User undertakes not to copy all or part of the Site onto another site or an internal company network. Manidou cannot be held responsible for the uses made by Users of the data accessible on the Site.
7 - Protection of personal data
All customer data is treated strictly confidentially and Manidou undertakes to respect the ethical rules issued by the ASVPC as well as the legislation in force, particularly with regard to data protection.
We only use your data for the proper processing of your order. The email address provided during your registration will only be used to inform you of our new sales. You can unsubscribe at any time. Manidou undertakes not to communicate your personal data to third parties for commercial purposes.
To make your visit more interactive and to facilitate the use of certain functions, we use cookies. These are text files that are placed on your hard drive. Most of our cookies are deleted from your hard drive at the end of your visit (temporary/session cookies, etc.). Other cookies remaining on your computer will allow our site to recognize you during your next visit (permanent cookies). Under no circumstances will our partners be authorized to determine, process or use your personal data via cookies.
Your data is kept by Manidou. According to the federal law on the protection of personal data, you have the possibility to object to the processing of data concerning you and have the right to withdraw your consent at any time by contacting our customer service.
8 - Conditions of use of the site
Use of the site www.manidou.com is authorized for private use only. Any commercial use, in particular for the purposes of reselling products purchased on the site to third parties, is prohibited.
Any violation of this obligation will be punished. Damages are reserved.
9 -Applicable law and Jurisdiction
Relations between MANIDOU DESIGN SARL and the Client are governed by Swiss law.
For any dispute relating to relations between MANIDOU DESIGN SARL and the client, the place of jurisdiction is at the headquarters of the company MANIDOU DESIGN SARL.
